These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and www.apnagram.in, a platform of M/s. Innorize Enterprises Private Limited ("Company," "we," "us," or "our") regarding your use of the www.apnagram.in website, mobile application, and all related services (collectively, the "Platform").

1. Acceptance of Terms

   By accessing, registering for, or using our Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, you must not access or use the Platform. Your continued use of the Platform signifies your ongoing acceptance of these Terms and any future modifications.

2. Eligibility

   You must be at least 18 years of age to create an account and use this Platform. By agreeing to these Terms, you represent and warrant that you are of legal age to form a binding contract. We reserve the right to terminate the account of any user who is found to be under the age of 18. Use of the Platform may be restricted in certain jurisdictions, and you agree to use the Platform only in locations where it is legally permitted. We may also terminate accounts of users who have previously violated our terms.

3. Account Registration & Security

   To access the core functionality of the Platform, such as asking questions, you must register for an account using a valid social media login or a mobile number verified by a One-Time Password (OTP). You agree to:

   1. Provide accurate, current, and complete information during the registration process.
   2. Maintain and promptly update your account details.
   3. Maintain the security and confidentiality of your account credentials. You are solely responsible for all activities that occur under your account, whether or not you have authorized such activities.
   4. Notify us immediately of any unauthorized use of your account.
   5. We reserve the right to suspend or terminate your account at our discretion if any information provided is found to be inaccurate, outdated, or incomplete, or if you violate any of these Terms.
4. User Conduct & Content Guidelines

   You are solely responsible for your conduct and any content you post, including questions, comments, and replies ("User Content"). You agree to interact respectfully with all users, including politicians and bureaucrats. You agree not to post, upload, or transmit any User Content that:

   1. Constitutes hate speech, incites violence, or is threatening, harassing, or defamatory.
   2. Is obscene, pornographic, or sexually explicit.
   3. Is discriminatory based on race, gender, religion, caste, nationality, disability, sexual orientation, or age.
   4. Promotes illegal activities or violates any local, state, national, or international law.
   5. Contains misinformation, disinformation, or "fake news."
   6. Infringes upon the intellectual property, privacy, or other rights of any third party.
   7. Contains spam, unauthorized advertising, or solicitations.
5. Content Ownership and Licensing

   You retain full ownership of the User Content you create and post on the Platform. However, by posting User Content, you grant the Platform and Company a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, host, store, reproduce, modify, create derivative works, communicate, publish, publicly perform, and publicly display your User Content. This license includes, but is not limited to, the rights necessary for operating, promoting, commercializing, monetizing, and improving the Platform and its services, including making your content available to other users, partners, and third-party services as part of the platform’s functionality and business operations.

6. Moderation and Enforcement

   While we are not obligated to monitor all User Content, we reserve the absolute right to review, screen, and remove any User Content at any time and for any reason without notice, especially if it violates these Terms. We may use a combination of automated systems (AI) and human moderators to review content. Enforcement actions may include issuing warnings, removing content, and temporarily or permanently suspending or terminating user accounts.

7. Privacy Policy Reference

   Your privacy is important to us. Our Privacy Policy, which is incorporated by reference into these Terms, explains how we collect, use, and protect your personal data. Please review the Privacy Policy carefully to understand our practices regarding your information.

8. Intellectual Property

   All rights, titles, and interests in and to the Platform itself—including its "look and feel," logos, trademarks, user interface, software, and other source code—are and will remain the exclusive property of M/s. Innorize Enterprises Private Limited and its licensors. You may not copy, modify, distribute, sell, or lease any part of our Platform or its intellectual property.

9. Third-Party Links and Services

   The Platform may contain links to third-party websites, services, or advertisements that are not owned or controlled by us. We do not endorse or assume any responsibility for any such third-party sites, information, materials, products, or services. If you access a third-party website from the Platform, you do so at your own risk, and you understand that these Terms and our Privacy Policy do not apply to your use of such sites.

10. Online Payments and Billing

    Payment Processing

    All online payments for services or products on this Portal are processed through our authorized third-party payment gateway, Razorpay Software Private Limited ("Razorpay"). By proceeding with a payment, you agree to be bound by Razorpay’s Terms of Service and Privacy Policy, in addition to these Terms.

    Accepted Payment Methods

    We accept payments via the methods supported by Razorpay, which may include:

    • Credit and Debit Cards (Visa, Mastercard, Rupay, Maestro, Amex)
    • Net Banking (All major Indian banks)
    • UPI (Unified Payments Interface)
    • Mobile Wallets (Paytm, PhonePe, Freecharge, etc.)
    • EMI options (if applicable to your specific portal)

    Currency and Taxes

    • All transactions are processed in Indian Rupees (INR).
    • The amount displayed at checkout is the final amount, inclusive of applicable taxes (GST) unless explicitly stated otherwise.
    • Any currency conversion charges or bank charges for international cards are the sole responsibility of the user.

    Payment Data and Security

    • Data Handling: We do not store your complete card details (such as CVV numbers) on our servers. Your payment data is securely transmitted directly to Razorpay for processing.
    • Security: Razorpay is a PCI-DSS (Payment Card Industry Data Security Standard) compliant service provider. While we take all reasonable precautions to secure your payment data, we cannot be held liable for any loss or damage arising from third-party security breaches that are beyond our reasonable control.

    Failed Transactions

    • In the event of a failed transaction where money is deducted from your account but the order is not confirmed on our Portal:
    • Please do not initiate a second payment immediately.
    • The deducted amount is typically auto-refunded by your bank within 5-7 business days.
    • If the refund is not received within this timeframe, please contact our customer support with your Transaction ID for assistance.

    Refunds and Cancellations

    • Refund Processing: Valid refund requests (as per our Refund Policy) will be processed through the Razorpay dashboard.
    • Timeline: Refunds typically take 5-7 working days to reflect in your original source of payment (Bank Account/Card/Wallet) after we have initiated the refund.
    • Source Refund: Refunds are strictly credited back to the original payment method used during the transaction. Cash refunds are not permitted.

    Chargebacks and Disputes

    • You agree not to issue a chargeback (dispute the transaction with your bank) without first attempting to resolve the issue with our customer support team.
    • Unjustified chargebacks may result in the suspension of your account on our Portal and may be reported to relevant regulatory bodies.

    Limitation of Liability (Payment)

    We shall not be liable for any damages, interests, or claims resulting from the non-processing of a transaction or any delay in processing a transaction which is beyond our control or control of Razorpay.

11. Disclaimers and Limitation of Liability

    The Platform is provided on an “AS-IS” and “AS AVAILABLE” basis. To the fullest extent permissible by law, we disclaim all warranties, express or implied, in connection with the Platform and your use thereof. We do not warrant that the Platform will be secure, uninterrupted, or error-free.

    Www.apnagram.in is an intermediary platform and is not liable for the content posted by its users or the responses (or lack thereof) from politicians or bureaucrats. In no event will the Company, its directors, employees, or agents be liable to you for any direct, indirect, incidental, special, or consequential damages whatsoever resulting from any errors, personal injury, unauthorized access to our servers, or any interruption of service.

12. Termination of Use

    We may terminate or suspend your access to the Platform immediately, without prior notice or liability, for any reason whatsoever, including a breach of these Terms. Upon termination, your right to use the Platform will cease immediately. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability. 13. Changes to Terms

    We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice before any new terms take effect by posting the updated Terms on our Platform or by notifying you through your registered email or mobile number. Your continued use of the Platform after such changes become effective constitutes your agreement to the new Terms.

14. Governing Law and Jurisdiction

    These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Hyderabad, India, to resolve any legal matter arising from these Terms.
